Terms of use
1. About these terms
These terms are an agreement between you and Nil Basora, the developer of MosaicMe (“we”, “us”), for your use of the MosaicMe app for iPhone. When you use the app, you accept these terms. If you do not accept them, do not use the app.
2. What MosaicMe does
MosaicMe turns photos on your iPhone into mosaics, collages and short videos. The app is free. MosaicMe Pro is an optional one-time in-app purchase that adds more features.
3. Your licence
We give you a personal, non-exclusive, non-transferable licence to use MosaicMe on Apple devices that you own or control, as the Usage Rules of the Apple Media Services Terms and Conditions allow. You may not copy, change, reverse engineer or redistribute the app, except where the law gives you that right.
4. MosaicMe Pro
- Pro is a one-time purchase. You pay once, and it does not renew.
- Apple takes the payment under its own terms, and the App Store shows the price in your currency.
- Pro stays unlocked for the Apple Account that bought it. On another iPhone, use Settings › Restore Pro purchase.
- Pro works with Family Sharing: members of your Apple family group can use it, as Apple’s Family Sharing terms allow.
- Apple handles refunds. You can ask for one at reportaproblem.apple.com.
5. Your photos and your creations
- Your photos stay yours, and so do the mosaics and videos you make. We claim no rights over them, and we never receive them.
- You may use your creations for any lawful purpose, including printing them, giving them as gifts and selling prints, as long as you hold the rights to the photos in them. The shapes, layouts and fonts that MosaicMe adds to your creations may be used together with them.
- You are responsible for having the rights and permissions for the photos you use, in particular photos of other people, and for how you share or print your creations.
6. Fair use
Do not use MosaicMe to make or share content that is illegal, that infringes the rights of others, or that harms or harasses anyone.
7. Privacy
The privacy policy explains how we handle data. In short: your photos, faces and names stay on your iPhone.
8. Changes to the app
We may improve, change or remove features. We work to keep MosaicMe running on the iOS versions it supports, but we cannot promise that the app will always be available or free of errors. Keep your own copies of the photos and creations that matter to you.
9. Warranty
As far as the law allows, MosaicMe is provided “as is”. If you are a consumer, you keep all the rights that the law gives you, including the rights that apply when digital content does not work as described.
10. Liability
As far as the law allows, we are not liable for indirect or consequential loss, or for loss of data, and our total liability to you is limited to the amount you paid for Pro. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow us to limit.
11. Apple
These points apply because you got MosaicMe from the App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Apple has no obligation to give maintenance or support for the app.
- If the app does not conform to a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for it. As far as the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims about the app, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If someone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not in a country that is subject to a US Government embargo or that the US Government has designated as a “terrorist supporting” country, and that you are not on a US Government list of prohibited or restricted parties.
- When you use the app, you must follow the terms of any third-party service you use with it.
- Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right to enforce them against you.
12. Law and disputes
Spanish law applies to these terms. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there.
13. Changes to these terms
We may update these terms. We publish the new version here with a new effective date, and we tell you in the app if a change is important. If you keep using the app after a change, the new terms apply.
